GETUS Communications Ltd also operates as “GETUS” and “GETUS Communications”. GETUS is registered and govern in the Province of Alberta and Federally in Canada. All municipal, provincial and federal laws are abided by GETUS Communications and enforced.
Generalization of disallowed content on any of our services. These terms and conditions apply to all services provided by GETUS Communications Ltd.
GETUS Communications Ltd does not allow storage and/or display of the following materials on its servers or services. This includes uploading on to web services or transmitting by any form (such as e-mail, uploading, posting).
GETUS Communications Ltd services may not be used for illegal purposes, or in support of illegal activities. Copyright or trademark infringement: Use of GETUS Communications Ltd service to transmit any material (by e-mail, uploading, posting, hot linking, directly linking or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. Distribution of Viruses, Spyware, and Malware: distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Distribution of software that monitors computer or computer user activity without the computer user’s knowledge and consent is prohibited.
Generally we do not put a limit on CPU usage. We allow a fair usage of CPU on all servers. This means that as long as your service does not cause the whole server load to increase, your services will remain active. Any service using a large amount of CPU causing overall server load increment will be suspended automatically with/without notifications. Kindly open a support ticket to get it unsuspended. We will then recommend you to optimize your scripts before hosting on our servers or giving you different service recommendations.
Spamming (sending unsolicited advertisements or bulk emails) using our servers is strictly not allowed. DO NOT SEND SPAM EMAIL FROM OUR SERVERS. Sending spam emails, which include links to a web service hosted on one of our servers, is also forbidden. We reserve the right to suspend or terminate any service that is linked to spam emails. To protect our servers we may impose limits on the number of emails sent within a particular time frame from our servers.
We have a zero tolerance policy for the use of our network for the posting of messages or commercial advertisements, which violate the rules, regulations, FAQ or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.
We want to allow our customers to use our services in the best ways possible, but in order to protect others, we may, temporarily or not, suspend a service if this slows down our servers or services. In this case, we will try to find a solution together with the customer. You may not use your service to publish material, which GETUS Communications Ltd determines, at its sole discretion, to be unlawful, indecent or objectionable. For purposes of this policy, “material” refers to all forms of communications including narrative descriptions, graphics (including photographs, illustrations, images, drawings, logos), executable programs, video recordings, and audio recordings. You must take reasonable steps to protect the security of our servers. This includes, but is not limited to: Keeping all passwords to GETUS Communications Ltd systems secure. You must not reveal your passwords to third parties, ensuring that any scripts that are installed on your service cannot be exploited to compromise the security or the server.
The following constitute violations of GETUS Communications Ltd
GETUS Communications Ltd services may not be used for illegal purposes, or in support of illegal activities. GETUS Communications Ltd reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrong doing.
Use of the GETUS Communications Ltd service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography.
Use of the GETUS Communications Ltd service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
Use of the GETUS Communications Ltd service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another.
Use of the GETUS Communications Ltd service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as “pyramid schemes,” “ponzi schemes,” “hyip schemes,” and “chain letters.”
Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
Use of the GETUS Communications Ltd service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations will result in the immediate termination of the offending GETUS Communications Ltd account.
Use of the GETUS Communications Ltd service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of GETUS Communications Ltd or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending account is subjected to immediate termination.
Use of fraudulent referrers to a service hosted on our servers is forbidden. This includes, but is not limited to, blog ping backs. Inappropriate (e.g. off-topic or automated) postings to forums, or other services containing links to a service hosted on our servers is forbidden.
Use of server software or scripts, which creates a listening socket on our server, is forbidden. Proxies who receive requests over HTTP and use our network connection to forward the request to another server are not permitted. This includes, but is not limited to, HTTP proxies.
Use of software and scripts for “file sharing”, “bit torrents” or similar is not allowed on our servers. This includes sending or receiving files using these mechanisms.
You are responsible for ensuring that any scripts that you install do not compromise the security of our servers. This includes, but is not limited to: Ensuring that it is not possible to abuse such scripts to gain access to the file system of the server. ensuring that it is not possible to abuse such scripts to send emails to third parties. ensuring that you update any installed scripts with the latest releases, which often contain security fixes. If a script installed on your service is compromised, we may require a clean up of your service. Where we provide an automatic script installer we may update installed scripts to the latest releases.
If we detect that you have been using hosting or service provided by GETUS Communications Ltd or a reseller of our services for malicious purposes we reserve the right to either remove the script, object, WebPages, or other file or suspend or terminate your account in its entirety without notice. If reports are received of attacks originating from your hosting are verified as true, you would be assessed a 100USD fee.
We may have, from time to time, to perform maintenance, upgrades or replacements to our servers and services. We reserve the right to suspend access to such servers during the required time to do the maintenance, upgrade or exchange the server. For regular or emergency maintenance, no compensation will be provided unless otherwise stated in a Service Level Agreement (SLA).
GETUS Communications Ltd cannot be held responsible for any damage caused to your business or residential property, even if the damage is directly caused by one of our employees. GETUS Communications Ltd cannot be held responsible for any loss of data or service interruption, but will do its best to help the customer. You, as a GETUS Communications Ltd customer, are solely responsible for the content stored on and served on our services.
Internet is never guaranteed on visits (good things take time, at times), we reserve the right to cancel any account if we are unable to service the address (with full refund exception incl. Activation Fees), if Internet can be brought to the address and there is a delay, we must await for the vendor partner to complete the work (no-refund will be provided). The Activation fee(s) are non-refundable (unless vendor informs we are unable to service address). First month of service can be refunded if requested 48 hour(s) from when client had ordered services (exception – no refund is provided if vendors are working and assigned to the case). If vendor deems we are unable to service address, refund will be provided in full to the client within 5 business days.
We may provide a backup service for your service, however, we do not accept responsibility for any failure of our backup mechanism. Therefore – we recommend all clients to take regular backups of their files. You are responsible for maintaining adequate backups of your content despite the backup we provide.
We may modify any of these terms and conditions contained, at any time and in our sole discretion, by posting a change notice or a new agreement on our service. Your continued participation now, or within thirty (30) days following the posting notice of any changes in these terms and conditions, will constitute a binding acceptance by you of such rules, changes or modifications. If any modification is unacceptable to you, your only recourse is to terminate your account(s). In this case, a pro-rata repayment of services will be made.
All payment disputes must be raised by phone or e-mail confirmation. If you dispute a payment through your credit card company, through PayPal or another financial institution we may immediately suspend or terminate all services you have purchased from us. We may levy a charge of $50CAD per dispute instance, payable before we restore your services. If we are charged a chargeback settlement fee, or other fee related to the payment dispute, we may pass this fee onto you.
You may cancel or terminate your services providing GETUS as little as 1-day notice. Account holders may cancel by logging in our client area and request cancellations from your product/services tab or calling into Client Care during regular business hours. GETUS Communications Ltd terminates accounts, note that once a cancellation request has been submitted we are unable to remove the request. Re-activation fee of service would be required with all applicable fees. Returning of rental equipment must be returned within 30 day(s) after services have been disconnected. GETUS Communications Ltd will provide a return label instructions for rental equipment. Purchased equipment can only be returned within 30 day(s) of purchase, subject to a $25 restocking fee (plus additional taxes). If the equipment is not returned within 45 day(s), we reserve the right to charge full MSRP (incl. application taxes).
GETUS Communications Ltd reserves to the right to suspend, terminate for un-fair use/abuse on our systems, including network. Some of our Services are offered or described as being “unlimited” or “Unmetered” in nature. This is subject, at all times, to reasonable usage limits for personal use by an individual or business. If we determine, in our sole discretion, that your usage is excessive or unreasonable, we reserve the right to limit or restrict your usage or to terminate your subscription to either the unlimited offering or the Services generally and to refuse to provide you Services thereafter. We will use reasonable efforts to notify you if we decide to take such actions, but also reserve the right to do so without notice.
We may suspend any or all of your services when we have any reason(s) to suspect a violation of our terms and conditions while we investigate the suspected violation. We may suspend your services when we have reason(s) to suspect that a script installed on your service is being abused while we investigate the suspected abuse. All clients are required to open a support ticket to get their account unsuspended or contact Client Care.
If we suspect that activities performed by you or a third party on your hosting account, whether deliberate or not, may compromise the security of our server or any other server or computer, we may require a clean up to be performed. A simple clean up will be provided free of charge, which resulting in total loss of existing data on your hosting account. You should then restore the service from your backups. Depending on the severity, we may agree to perform a complex clean up (targeting only compromised files), for which we will charge support at our standard support rate.
If you violate our terms and conditions we may terminate or suspend (temporarily or indefinetely) any services you have with us. In this case no refund will be given for any payments that have been, or are made by you to us. Any abuse, threats, and bad words to any of our staff members will be an automatic suspension or termination of your service without any refunds. Following a violations of or terms and conditions, we may levy an investigation charge of $50CAD per instance.
All late invoice payment will be charged a one-time $35CAD Late Fee if 72 hour(s) after the renewing period. Clients product/services will be unsuspended once the payment has been made. We ask for up to 5-7 business days to re-activate your service. Note, application activation fees may be application for re-connection.
Money back Guarantee & Cancellation prior to Activation
GETUS Communications Ltd will allow a partial refund (minus $25 (plus additional taxes) modem restocking fee for purchased modems returned) prior to Activation date of service scheduled by the assigned vendor. Refunds will be provided within 5 business days (unless pending equipment return) to the original payment method and requests must be made by phone or e-mail. All equipment (purchased one-time or rental) is to be returned within 30 day(s), if not returned within 45 day(s) equipment will be charged at full MSRP (plus additional taxes).
If for any reason the Vendor advises the address is non-serviceable (during any timeframe of the order), a full refund will be provided including a $0 restocking fee for the modem/equipment if applicable. These requests including approval must be provided by phone or e-mail.
As some of our services may require a contract or may include month to month, all payments must be accounted for on the duration of payment methods. If the payment has not been made within 90 day(s), even if the service is inactive we have the right to give your details to a collections agency to attempt to get those funds. We will arrange payments with our Client Care team to avoid submitting to a collection agency. If an invoice was generated with questioning, please contact our Client Care team and we will happily clear things up. Proper cancellation of service will not involve further generation of invoices.
We reserve the right to change/edit/modify these terms at anytime.
